Under fundamental assumptions of unenumerated rights as well as the plain language of the Ninth Amendment, I certainly do have legal, technical right to 'be' queer, and more practically I have the technical right to all the queer sex I care to have (with other consenting adults). Contrary legal opinions, frankly, are uniformly so poorly reasoned that I tend to regard the entire opposing camp as thoroughly intellectually bankrupt.
